For a friendly reminder, email is fine. For a firm follow-up or final demand, consider sending via certified mail (USPS Certified Mail with return receipt) so you have proof of delivery. This matters if you later file in small claims court. You can also send by email AND certified mail for maximum impact.

What are the freelancer protection laws mentioned in the Final Demand letter?

These laws (the Freelance Isn't Free Act in NY, Freelance Worker Protection Act in CA and IL) provide remedies that may include double damages and attorney's fees for qualifying disputes. Each law has specific eligibility conditions, including minimum contract amounts ($800 in NY, $250 in CA, $500 in IL) and requirements around written contracts. If you are in one of these states, select the Final Demand template, and your invoice amount meets the threshold, the letter automatically includes a reference to your state's law. Always verify that your specific situation qualifies.

What if my client is in a different state than me?

Cross-state disputes are common for freelancers. These freelancer protection laws have different applicability rules: California's law covers hiring parties located in California (BPC 18101(b)). New York's statewide FIFA applies broadly but still has specific scope conditions. Illinois covers services performed in Illinois or hiring parties in Illinois. If you and your client are in different states, the jurisdictional analysis depends on the specific facts of your engagement. For cross-state disputes involving significant amounts, consulting an attorney is recommended.

We do not store copies of generated letters or the personal details you enter.
